Referendum second draft 1156-11-70 (adopted on August 18, 2025) amending the zoning by-law

NOTICE is hereby given that, following the public consultation meeting, which was held on August 18, 2025, the municipal Council of "Ville de Gaspé" has accepted by resolution, on August 18, 2025 a second draft of by-law 1156-11-70 amending the zoning by-law.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the zones to which such provisions apply and of the contiguous zones, to require that a by-law containing these be submitted for their approval, in accordance with the Act respecting elections and referendums in municipalities.

1.      PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

         1.1     An application relating to the following provision of the second draft:

  • Modifiant le point 1) Habitation du tableau NOMBRE DE CASES DE STATIONNEMENT* de l’article 4 NOMBRE DE CASES DE STATIONNEMENT* en ajoutant une cinquième catégorie

Such an application is required that the by-law containing this provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

         1.2     An application relating to the following provision of the second draft:

  • Modifiant le paragraphe de l’article 6 STATIONNEMENT* COMMUN en ajoutant les zones M-278 et M-279

Such an application is required that the by-law containing this provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

         1.3     An application relating to the following provision of the second draft:

  • Ajoutant un troisième point à l’article 12.2 AFFICHAGE DANS UNE ZONE* OU UNE CLASSE D’USAGES* DU GROUPE HABITATION OU DE LA CLASSE D’USAGES* HEBERGEMENT LEGER (C-9) EST AUTORISEE

Such an application is required that the by-law containing this provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

         1.4     An application relating to the following provision of the second draft:

  • Modifiant les usages autorisés dans la zone RT-169 afin de permettre comme usage spécifiquement permis dans cette zone, l’usage Vente au détail de poissons et de fruits de mer (5422).

Such an application is required that the by-law containing this provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

2.  LOCALIZATION OF THE CONCERNED ZONES

The concerned zones M-278 and M-279 are located in the area of the York East boulevard and are illustrated in the following sketches:

3.      VALIDITY OF AN APPLICATION

         To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons from the area from which it originates, or by at least a majority of them if the number of interested persons in the area does not exceed 21. Each signature must be accompanied by the person's name, address, and a statement indicating the person's capacity as signatory;
  • be received no later than the eighth day following the publication date of this notice, i.e., August 29, 2025, at 4:30 p.m. This request must be sent to the town clerk by email at isabelle.vezina@ville.gaspe.qc.ca or by mail to 25, rue de l’Hôtel-de-Ville, Gaspé (Québec) G4X 2A5.

4.      INTERESTED PERSONS ENTITLED TO SIGN AN APPLICATION

4.1    Any person who, on August 18, 2025, is not disqualified from voting as provided for in section 524 of the Act respecting elections and referendums in municipalities (chapter E-2.2) and meets the following conditions:

  1. be a natural person domiciled in the zone from which an application may originate and have been domiciled in Quebec for at least six months;
  1. be of full age and a Canadian citizen and not be disqualified from voting as a result of a judgment rendered under section 288 of the Civil Code of Quebec (chapter CCQ-1991).

4.2    Any sole owner of a building or sole occupant of a business establishment who is not disqualified from voting and meets the following conditions:

  1. must be the owner of a building or the sole occupant of a business establishment located in the zone from which an application may originate since at least August 18, 2025;
  2. in the case of a natural person, must be of legal age and a Canadian citizen and must not be disqualified from voting as a result of a judgment rendered under section 288 of the Civil Code of Québec (chapter CCQ-1991).

4.3    Any undivided co-owner of a building or co-occupant of a business establishment who is not disqualified from voting and meets the following conditions:

a) must be an undivided co-owner of a building or co-occupant of a business establishment located in the zone from which an application may originate, since at least August 18, 2025;

b) must be designated, by means of a power of attorney signed by the majority of the persons who have been co-owners or occupants since at least August 18, 2025, as the person entitled to sign the application on their behalf and to be included on the referendum list, if applicable. This power of attorney must be filed before or at the same time as the application.

4.4    In the case of a legal person, the following must be done:

a) by resolution, a person designated from among its members, directors, or employees who, on August 18, 2025, and at the time of the application, is of full age and a Canadian citizen and is not disqualified from voting under any law.

b) a resolution designated the person authorized to sign the application and be entered on the referendum list, if applicable.

Except in the case of a person designated as a representative of a legal person, or a person designated as a representative of several legal persons, no person may be considered an interested person in more than one capacity in accordance with section 131 of the Act respecting land use planning and development (chapter A-19.1) and section 531 of the Act respecting elections and referendums in municipalities (chapter E-2.2). Under these sections, a person who is an interested person in the affected areas in more than one capacity is registered under only one of these capacities, according to the following order of priority:

a) as a domiciled person;

b) as the sole owner of a building;

c) as the sole occupant of a business establishment;

d) as an undivided co-owner of a building;

e) as a co-occupant of a business establishment.

  1. LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

6.      CONSULTATION OF THE DRAFT

The second draft of by-law is available, in French, for consultation at the Clerk’s office at 25, rue de l’Hôtel-de-Ville during regular work hours, that is from 8 h 15 am till 12 h and from 1 h till 4 h 30 pm, Monday till Thursday, and from 8 h 15 am till 12 h on Friday.
